Outrack Terms of Use

1. Introduction

Welcome to Outrack, a service provided by Solva (“we,” “our,” or “us”) on the domain outrack.io. By accessing or using the Outrack service, you agree to be bound by these Terms of Use (“Terms”) and our Privacy Policy. Please read them carefully.

2. Service Description

Outrack offers email tracking services exclusively for Microsoft Outlook users, enabling tracking of email opens and clicks. The service automatically adds tracking functionality to emails unless the user opts out. Tracking is achieved through:

• Open Tracking: Inserting a hidden image within the email that signals when an email is opened.
• Click Tracking: Replacing original URLs with special short URLs that log clicks before redirecting to the intended destination.

Users receive email notifications for opened emails and can access their tracking history via the Outrack Outlook Add-in Interface and the Outrack service dashboard. Data stored includes:

• Encrypted login credentials
• Sender and recipient emails and IP addresses
• Subject lines
• Timestamps of sent and opened emails
• Tracked URLs and clicks

3. User Obligations

By using Outrack, you agree to:

• Maintain Active Subscription: Keep your subscription active to continue using the service. Inactive subscriptions will automatically discontinue the service without prior notice, though we will attempt to notify you.
• Security of Credentials: Use strong passwords and keep your login credentials confidential. You are responsible for all activities that occur under your account.
• Acceptable Use: Refrain from using the service for spamming, spoofing, phishing, or any unlawful activities. We reserve the right to terminate or suspend your access if we detect suspicious or prohibited activities.
• Compliance with Laws: Use the service in compliance with all applicable laws and regulations, including but not limited to privacy laws and email regulations.
• Microsoft Outlook Requirement: Ensure you have a functional Microsoft Outlook system with necessary subscriptions active for Outrack to function properly.

4. Prohibited Activities

You agree not to:

• Use the service to send unsolicited or unauthorized advertising, spam, or chain letters.
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• Engage in any activity that could harm or disrupt the service or servers.

5. Data Collection & Privacy

Our collection and use of personal data are governed by our Privacy Policy. Key points include:

• Data Collected: We collect data such as login credentials (encrypted), sender and recipient emails and IPs, subject lines, timestamps, tracked URLs, and clicks.
• Third-Party Sharing: We share your email address and User ID with our payment processor, Paddle. We do not store or handle any payment information; all payment data is managed by Paddle.
• Data Security: Sensitive data is encrypted, and we employ industry-standard security measures to protect your information.

6. Liabilities & Warranties

Accuracy of Tracking: While we strive for high accuracy, we do not guarantee 100% accuracy in tracking email opens and clicks due to factors beyond our control, such as email provider security measures and spam filters.

Service Availability: We do not guarantee uninterrupted service and are not liable for any disruptions caused by third-party services, including Microsoft Outlook and Paddle.

7. Payment & Subscriptions

Outrack operates on a subscription model. The service remains active only while your subscription is active.

All payments are processed by Paddle. By subscribing, you agree to Paddle's Terms of Use.

Refund Policy:

• Full Refunds: Granted if the service is non-functional due to our fault and if the request is made within 14 days of the initial payment.
• Partial Refunds: Prorated refunds may be granted after the initial 14 days if the service is non-functional due to our fault.
• No Refunds: Issued for issues caused by third-party services or for recurring payments if prior notification was provided.

8. User Termination

You may cancel your subscription at any time. The service will remain active until the end of the paid subscription period and will then be discontinued.

We reserve the right to terminate or suspend your access to the service for violations of these Terms or any applicable laws.

9. Amendments to Terms

We may update these Terms at any time. You will be notified of significant changes via email. Continued use of the service after such notifications constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England. Any disputes arising shall be subject to the exclusive jurisdiction of the English courts.

11. Third-Party Services

Microsoft Outlook Dependency: Outrack relies on Microsoft Outlook services. We are not responsible for any issues arising from Microsoft Outlook's functionality.

Payment Processing: All payments are handled by Paddle. We are not responsible for any issues related to payment processing.
